Terms of sale and withdrawal

1. Seller

2. Scope and contract formation

These terms apply to purchases made in the IRTAVIA shop. Essential characteristics, prices, taxes, shipping, payment methods and delivery times are shown before ordering. Entries can be reviewed and corrected in the basket and during checkout before the order is submitted.

3. Production and delivery

Most pieces are made after ordering. Production time and estimated delivery will appear on the product page and confirmation. Making an unchanged catalogue item to order does not remove the statutory withdrawal right. Risk passes only when the consumer or their nominated third party, other than the carrier, receives the goods.

4. Right of withdrawal

Consumers may withdraw from a distance contract within 14 calendar days without giving a reason. The period generally starts when the consumer or nominated third party receives the goods; for separate deliveries, on receipt of the last item or part.

An unequivocal statement by email to info@irtavia.com or post to the stated address is sufficient. The model form may be used but is not required. Sending it within the deadline is sufficient.

5. Effects and returns

Payments, including the least expensive standard-delivery cost, will be reimbursed without undue delay and within 14 days after the statement is received. Extra costs for another delivery method are not reimbursed. The original payment method is used unless otherwise agreed, without fees.

Reimbursement may be withheld until the goods or proof of return is received. Goods must be returned within 14 days; the consumer bears direct return costs and is liable only for diminished value caused by handling beyond what is necessary to assess nature, characteristics and function.

6. Exclusions

Withdrawal is excluded in particular for goods made to individual specifications or clearly personalised. The exclusion does not apply merely because an unchanged standard item is produced after ordering. Rights for faulty, damaged or incorrect goods remain unaffected.

8. Statutory conformity rights

Statutory rights for lack of conformity apply to new goods. Under Spanish law IRTAVIA is liable for non-conformity existing on delivery and appearing within three years. Statutory remedies, particularly repair or replacement, price reduction or termination, remain available. IRTAVIA bears necessary costs.

9. Complaints and alternative resolution

Complaints should be sent to info@irtavia.com. If a consumer complaint cannot be resolved directly, information will be supplied on a durable medium within one month about at least one competent recognised alternative-dispute-resolution body and whether IRTAVIA will participate. The former EU online dispute-resolution platform has closed and is not linked.

10. Applicable law

Spanish law applies, without prejudice to mandatory consumer-protection and jurisdiction rules in the consumer’s country of habitual residence.
